Terms of Service

1. Acceptance of Terms

By accessing, registering for, or using Prevesto (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and Prevesto ("we", "our", or "us"), a company registered in the Netherlands. By using the Service, you represent that you have the legal capacity to enter into these Terms.

We recommend reading these Terms in conjunction with our Privacy Policy and Cookie Policy, which are incorporated by reference into these Terms.

2. Description of the Service

Prevesto is a personal and family budgeting platform that enables you to:

  • Create and manage budgets with customizable categories and time periods.
  • Record and track financial transactions.
  • Monitor account balances and financial health.
  • Share financial data with family members through the family sharing feature.
  • Access your data across web and mobile applications.

Important disclaimer

Prevesto is a budgeting and financial organization tool. It is not a financial advisor, investment platform, bank, or licensed financial institution. We do not provide financial, investment, tax, or legal advice. The information displayed in the Service is based solely on data you enter. Always consult a qualified professional for financial decisions.

The Service may introduce bank account connectivity in the future through regulated third-party open banking providers. Such features will be subject to additional terms communicated at the time of launch.

3. Account Registration

  • Age requirement: you must be at least 16 years of age to create an account and use the Service. By registering, you confirm that you meet this requirement. This is in compliance with the Dutch implementation of the GDPR.
  • Accurate information: you agree to provide accurate, current, and complete information during registration and to update this information to keep it accurate.
  • Account security: you are responsible for maintaining the confidentiality of your account credentials, including your password and any two-factor authentication (2FA) methods. We strongly recommend enabling 2FA for enhanced account security.
  • Account responsibility: you are responsible for all activities that occur under your account. You must notify us immediately at support@prevesto.com if you suspect unauthorized access to your account.
  • One person, one account: each account is for a single individual. You may not share your account credentials with others. Use the family sharing feature to collaborate with family members.

4. Subscription Plans

4.1 Plan Types

The Service offers the following subscription plans:

  • Free plan: provides access to core budgeting features with certain limitations as described on our pricing page.
  • Pro plan: provides access to the full feature set, including advanced reporting, family sharing, unlimited categories, and priority support. Pricing is available on our pricing page and is quoted in euros (EUR).

4.2 Free Trial

New users may be eligible for a 14-day free trial of the Pro plan. During the trial period:

  • You will have full access to all Pro features.
  • No payment information is required to start the trial.
  • At the end of the trial, your account will automatically revert to the Free plan unless you subscribe to the Pro plan.
  • Your data created during the trial will be preserved, though access to Pro-only features will be restricted.
  • Each user is entitled to one free trial only.

4.3 Billing Cycles

Pro subscriptions are available in the following billing cycles:

  • Monthly: billed at the start of each monthly period.
  • Annual: billed at the start of each annual period at a discounted rate.

All prices are inclusive of applicable VAT where required. VAT rates may vary depending on your country of residence within the EU.

4.4 Price Changes

We reserve the right to modify subscription pricing. If we change prices, we will provide at least 30 days' advance notice via email. Price changes will take effect at the start of your next billing cycle following the notice period. If you do not agree with the new pricing, you may cancel your subscription before the change takes effect.

5. Payment Terms

5.1 Payment Processing

All payments are processed securely by Stripe, Inc., a PCI Level 1 certified payment processor. We do not store your full credit card details on our servers. By subscribing to a paid plan, you agree to Stripe's Terms of Service.

5.2 Automatic Renewal

Paid subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You authorize us to charge your payment method on file at each renewal.

5.3 Cancellation

  • You may cancel your Pro subscription at any time from your account settings.
  • Cancellation takes effect at the end of your current billing period. You will retain access to Pro features until that date.
  • No partial refunds are provided for unused time within a billing period.
  • After cancellation, your account will revert to the Free plan, and your data will be preserved but access to Pro-only features will be restricted.

5.4 Refund Policy

  • If you are unsatisfied with the Service, you may request a refund within 14 days of your initial Pro subscription purchase or within 14 days of an annual renewal, in accordance with EU consumer protection rules (Directive 2011/83/EU).
  • Refund requests should be sent to support@prevesto.com.
  • Refunds will be processed to the original payment method within 14 days of approval.
  • Monthly subscription renewals beyond the initial purchase are not eligible for refunds, but you may cancel to prevent future charges.

5.5 Failed Payments

If a payment fails, we will attempt to charge your payment method up to three additional times over a 14-day period. If all attempts fail, your subscription will be downgraded to the Free plan. We will notify you by email before any downgrade occurs.

6. Acceptable Use Policy

You agree to use the Service in compliance with all applicable laws and regulations. You must not:

  • Use the Service for any unlawful, fraudulent, or malicious purpose, including money laundering or tax evasion.
  • Attempt to gain unauthorized access to the Service, other user accounts, or any computer systems or networks connected to the Service.
  • Interfere with, disrupt, or place an unreasonable burden on the Service or its infrastructure.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
  • Use automated means (bots, scrapers, crawlers) to access the Service without our prior written permission.
  • Upload or transmit viruses, malware, or other harmful code.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Service to store or transmit material that infringes on the intellectual property rights of others.
  • Resell, sublicense, or redistribute the Service or any part of it without our prior written consent.
  • Circumvent any access controls, usage limits, or security features of the Service.

Violation of this acceptable use policy may result in immediate suspension or termination of your account.

7. User Content and Data Ownership

7.1 Your Data

You retain full ownership of all financial data, budgets, transactions, categories, and other content you enter into the Service ("User Content"). Prevesto does not claim any ownership rights over your User Content.

7.2 License to Prevesto

By using the Service, you grant Prevesto a limited, non-exclusive, non-transferable license to process, store, and display your User Content solely for the purpose of providing, maintaining, and improving the Service. This license terminates when you delete your data or close your account.

7.3 Data Export

You may export your User Content at any time from your account settings in commonly used formats (such as CSV or JSON). This right is guaranteed under the GDPR's right to data portability.

7.4 Aggregated Data

We may create anonymized, aggregated statistical data derived from the use of the Service. Such aggregated data cannot be used to identify you and is not considered personal data. We may use aggregated data for any lawful purpose, including analytics and service improvement.

8. Intellectual Property

The Service, including its design, code, features, graphics, logos, trademarks, and all other elements (excluding User Content), is the exclusive property of Prevesto and is protected by Dutch and international intellectual property laws, including copyright, trademark, and trade secret laws.

  • The Prevesto name, logo, and all related marks are trademarks of Prevesto.
  • You may not use our trademarks without our prior written consent.
  • Your use of the Service does not grant you any rights in or to any intellectual property of Prevesto, except the limited right to use the Service in accordance with these Terms.

9. Family Sharing

The family sharing feature allows you to share financial data with family members who also have Prevesto accounts. By using this feature:

  • Invitations: you are responsible for inviting only trusted family members. You control who has access and what permissions they have (view-only or edit).
  • Shared responsibility: you understand that family members with edit access can modify shared budgets and transactions. Prevesto is not responsible for changes made by authorized family members.
  • Data visibility: shared data is visible to all members of your family group. Consider carefully what financial information you choose to share.
  • Revoking access: you may remove family members from your sharing group at any time, which immediately revokes their access to your shared data.
  • Individual accounts: each family member must maintain their own individual Prevesto account. A Pro subscription on one account does not extend Pro access to other family members.
  • Privacy: refer to our Privacy Policy for details on how shared data is handled.

10. Service Availability

10.1 Uptime

We strive to maintain high availability of the Service and target an uptime of 99.5% measured on a monthly basis, excluding scheduled maintenance windows. This is a target, not a guarantee, and does not constitute a service level agreement (SLA).

10.2 Maintenance

We may perform scheduled maintenance that temporarily affects availability. When possible, we will provide advance notice of scheduled maintenance via email or in-app notification. We aim to schedule maintenance during low-usage hours (typically between 02:00 and 06:00 CET).

10.3 Modifications

We reserve the right to modify, update, or discontinue any feature of the Service at any time. If we discontinue a material feature of the Pro plan, we will provide at least 30 days' advance notice.

10.4 Force Majeure

We are not liable for any failure or delay in the performance of the Service due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of war, pandemics, power outages, internet disruptions, or government actions.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Prevesto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses.
  • Prevesto shall not be liable for any financial decisions you make based on data displayed in or derived from the Service.
  • Prevesto shall not be liable for any unauthorized access to or alteration of your data resulting from your failure to maintain the security of your account credentials.
  • Our total aggregate liability to you for all claims arising from or related to the Service shall not exceed the total amount you have paid to us in the 12 months preceding the claim, or EUR 100, whichever is greater.

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable Dutch or EU law, including mandatory consumer protection rights.

12. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing, Prevesto does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the Service will be accurate or reliable.
  • Any errors in the Service will be corrected.
  • The Service will meet your specific requirements.

This disclaimer does not affect your statutory rights as a consumer under EU law, which cannot be waived or limited by contract.

13. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Prevesto and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service in violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Your infringement of any third-party rights.
  • Any content you submit, post, or share through the Service.

This indemnification obligation shall not apply to the extent that the claim arose from Prevesto's own negligence or willful misconduct.

14. Termination

14.1 Termination by You

You may close your account and terminate these Terms at any time from your account settings. Upon termination:

  • Your active subscription (if any) will be cancelled, and no further charges will be made.
  • No refund will be provided for the remaining portion of a prepaid billing period, except where required by applicable consumer protection law.
  • You will have 30 days after account closure to export your data (see Section 14.3).

14.2 Termination by Prevesto

We may suspend or terminate your access to the Service:

  • For cause: immediately if you materially breach these Terms, violate the acceptable use policy, or engage in fraudulent or illegal activity.
  • For convenience: with at least 30 days' prior written notice via email. In this case, we will provide a pro-rata refund of any prepaid subscription fees for the unused period.
  • Account inactivity: if your Free plan account has been inactive for more than 24 consecutive months, we may close it after sending two email notifications (30 days and 7 days before closure).

14.3 Data Export on Termination

Upon termination of your account (whether by you or by us), you will have a 30-day grace period to export your User Content via your account settings or by contacting support@prevesto.com. After this 30-day period, your data will be permanently deleted from our active systems in accordance with our data retention policy.

14.4 Survival

Sections that by their nature should survive termination will survive, including but not limited to: intellectual property, limitation of liability, disclaimer of warranties, indemnification, governing law, and dispute resolution.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of laws principles.

If you are a consumer residing in the EU/EEA, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.

16. Dispute Resolution

16.1 Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first contact us at support@prevesto.com and attempt to resolve the dispute informally within 30 days.

16.2 Jurisdiction

If informal resolution is unsuccessful, any disputes shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands.

16.3 EU Online Dispute Resolution

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. Our email for ODR purposes is support@prevesto.com.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Prevesto regarding the use of the Service and supersede all prior agreements, representations, and understandings.

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Our failure to exercise any right under these Terms shall not constitute a waiver of that right.

19. Changes to These Terms

We may modify these Terms at any time. When we make changes:

  • Material changes: we will notify you via email and provide at least 30 days' notice before the changes take effect. Material changes include modifications to pricing, liability, or your rights.
  • Minor changes: we will update the "Last updated" date at the top of this page.
  • Your options: if you do not agree with the updated Terms, you may cancel your subscription and close your account before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
